Understanding Dubai Property Investment: Ownership, Costs and Risk Before You Buy

Dubai property can suit a range of objectives, from buying a home to holding a rental asset. But the right purchase depends on more than the advertised price or a projected yield. Buyers need to understand what rights they are acquiring, how the purchase will be registered, what ongoing costs apply and how easily they might sell later.

Start with the ownership right

The Dubai Land Department (DLD) is the government authority responsible for registering real estate rights in Dubai. The Real Estate Regulatory Agency (RERA) is the regulator responsible for areas including real estate activity and jointly owned property service charges.

Foreign buyers do not have an unrestricted right to purchase anywhere in Dubai. Under Dubai’s property framework, non-UAE nationals may acquire freehold ownership in areas designated for foreign ownership. Freehold means ownership without a fixed time limit. The exact property and its registration status matter: verify the specific unit or plot with DLD rather than relying only on a listing description. See Dubai Law No. 7 of 2006 and DLD’s buyer guidance.

A leasehold or other long-term right is different from freehold. Depending on the area and registered agreement, a buyer may acquire a time-limited interest, such as a leasehold or usufruct right. Check the duration, permitted use, renewal terms and transfer conditions in the relevant documents. Do not assume that every property marketed to overseas buyers carries the same ownership rights.

Before proceeding, confirm that the seller has the right to sell, that the property’s title and status match the contract, and that any mortgage, restriction, developer consent or outstanding charge is understood.

Established property and off-plan property have different risks

An established, or completed, property can usually be inspected before purchase. Buyers can assess its condition, layout and immediate surroundings, and may be able to review actual rental and service-charge information for the building. These advantages do not remove risks: maintenance may be required, the unit may take time to rent or resell, and its market value and rent can fall.

An off-plan property is bought before construction is complete. The buyer’s contract is generally a Sale and Purchase Agreement (SPA), which sets out the parties’ obligations, payment schedule, specifications and other terms. The purchase may offer a choice of unit or a staged payment plan, but it also brings additional uncertainties: construction and handover timing, final specifications, the development’s future supply and demand, and the buyer’s ability to meet payments if circumstances change.

For off-plan purchases, check the project and developer registration with DLD, read the SPA carefully and confirm the payment instructions independently. DLD’s project-registration process requires a project registration and an escrow account for off-plan sales. An escrow account is a project-related account used to receive funds under the regulated framework; it is not a promise of on-time completion or investment performance. DLD’s project registration information describes the approval process and requirements.

Oqood is DLD’s system for registering initial off-plan sales in the provisional register. DLD’s initial-sale registration service states that the developer registers the sale and that registration should occur within 90 days of signing the contract. Ask for evidence of the registration and retain the SPA, receipts and related documents. Never rely solely on a broker’s or developer’s verbal assurance about registration or payment arrangements.

Budget for costs beyond the purchase price

For a completed sale, DLD’s current Property Sale Registration page lists a registration fee of 2% of the sale value for the seller and 2% for the buyer. The parties may agree to a different allocation, so make sure the contract clearly states who pays which charges.

DLD also lists a separate service-partner charge for registration through a real estate registration trustee: AED 4,000 plus VAT for sales of AED 500,000 or more, or AED 2,000 plus VAT for sales below AED 500,000. Additional title-deed, map and government charges may apply depending on the property and transaction. These charges are separate from the 4% combined DLD registration fee.

Brokerage is another possible cost, but a commission rate should not be treated as automatically fixed. DLD guidance says the broker’s commission is determined by agreement. Check the signed brokerage agreement for the rate, VAT treatment, payment timing and the party responsible.

Other transaction costs may include a developer’s no-objection certificate (NOC), mortgage-related fees, valuation, conveyancing and currency-transfer costs. The amount and applicability depend on the property, parties and transaction. Request an itemised estimate before signing, and verify applicable fees with DLD, the trustee, the lender and other relevant providers.

Account for the cost of owning

Purchase costs are only part of the calculation. Owners of units in jointly owned buildings may pay annual service charges for the management, operation, maintenance and repair of shared areas and facilities. The amount varies by project, property type and year.

DLD’s Service Charge Index allows users to check approved service-charge information by project, use and year. Use it as a starting point, then confirm the current budget and any outstanding charges for the specific unit. Also consider utilities, insurance, repairs, furnishing, vacancy periods and, if the property is rented, leasing and management expenses. These costs can reduce net rental income, even when the property is occupied.

Consider financing and resale before committing

Mortgage availability depends on the buyer, property, lender and application. A lender may assess income, existing liabilities, residency status, deposit, property valuation and documentation. Regulatory limits are not a guarantee that a bank will approve a loan or offer a particular rate or amount. Buyers should obtain lender-specific terms and test affordability against possible changes in interest rates, income or exchange rates. The Central Bank of the UAE’s mortgage regulations provide the regulatory framework; mortgage advice should come from an appropriately qualified lender or adviser.

Property is also relatively illiquid compared with cash or listed investments. A sale can take time, and the achievable price depends on market conditions, competing listings, unit condition, building costs and buyer demand. There is no assurance that a property can be resold quickly, at a profit or for enough to repay outstanding finance. If you may need access to your capital within a short period, factor that into your decision.

A practical pre-purchase checklist

Before making a commitment:

  • Confirm the exact ownership right and the property’s DLD registration status.
  • For off-plan property, verify the developer, project, escrow details, SPA and Oqood registration process.
  • Review the full purchase-cost estimate, including agreed fee allocation and brokerage.
  • Check the approved service charge and clarify any arrears or planned works.
  • Compare financing terms and assess whether payments remain manageable under less favourable conditions.
  • Consider how long you can hold the property and what could affect rental income or resale.

Dubai property may form part of a considered investment or relocation plan, but no purchase is free of risk. Prices and rents can decline; costs, delays or vacancies can affect returns; and rules can change.
